Chicago man pleads guilty to delivering more than 900 grams of heroin

CHICAGO — A Chicago man pleaded guilty to delivering more than 900 grams of heroin today.

Attorney General Kwame Raoul made the announcement with Angie M. Salazar, Special Agent in Charge, Homeland Security Investigations, Chicago.

Freddy Gutierrez, 29, of Chicago, was found guilty of delivery of a controlled substance of more than 900 grams, a Class X felony. Gutierrez was sentenced to 15 years in prison and immediately remanded into custody by Kane County Circuit Court Judge Salvatore LoPiccolo Jr.

“The partnerships my office has forged with local, state and federal law enforcement agencies help prevent heroin and other dangerous substances from being distributed throughout Illinois,” Raoul said. “I appreciate the collaboration of the Kane County State’s Attorney and Homeland Security Investigations, which allowed us to hold accountable an individual who sought to distribute a large amount of heroin within the community.”

Raoul’s office prosecuted the case following an investigation by HSI. In May 2018, Gutierrez delivered more than 900 grams of heroin to an undercover officer at a Walmart parking lot in Aurora, Illinois. The Attorney General’s office prosecuted the case with Kane County State’s Attorney Jamie L. Mosser’s office.

“Drug Trafficking Organization investigations are especially effective when we collaborate with our federal, state and local law enforcement partners. HSI will continue to prioritize drug traffickers who operate in our community,” said Angie M. Salazar, special agent in charge, HSI Chicago. “Today’s sentencing of Gutierrez serves as a warning that HSI and its law enforcement partners will work diligently to hold drug dealers accountable for their actions.”

“In the last three years, more than 260 people in Kane County have died as a result of a heroin overdose, illustrating the extreme danger of this highly addictive drug,” said Kane County State’s Attorney Jamie L. Mosser. “The delivery of any controlled substance, especially heroin, is one that is taken with the utmost seriousness.”

“To his credit, Mr. Gutierrez has taken advantage of Sheriff Ron Hain’s drug treatment program in the Kane County Jail while his case was pending. It is my sincere hope that he has successfully addressed his addiction issues, understands the dangers of delivering drugs in our community and will be released from prison ready and willing to be a productive member of society. My thanks to all who helped to investigate and prosecute this matter making Kane County a safer community,” said Mosser.

Assistant Attorney General Gregg Gansmann prosecuted the case for Raoul’s Statewide Grand Jury Bureau. Bianca Camargo prosecuted the case for the Kane County State’s Attorney office.
