ERO Atlanta removes foreign fugitive wanted for murder

ATLANTA — U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) Atlanta, ERO Mexico, and the Security Alliance for Fugitive Enforcement removed an unlawfully present foreign fugitive wanted for homicide in his home country of Mexico.

Tivurcio Serrato Colorado, a 36-year-old unlawfully present Mexican national, was flown from Alexandria, Louisiana, to the Valley International Airport in Harlingen, Texas on Jan. 4. ERO Harlingen subsequently escorted him via ground transportation to the border and turned him over to Mexican authorities.

“Foreign fugitives who flee criminal prosecution in their home country with hopes of hiding out in the United States will quickly find that there is no safe haven for wanted criminals,” said Sean Ervin, field office director for ERO Atlanta. “Our immigration officers work closely with their state and local counterparts and are uniquely trained to track down unlawfully present foreign fugitives to repatriate them to their home country to face justice for the crimes they are alleged to have committed.”

Serrato Colorado entered the United States on an unknown date and at an unknown location without inspection or parole and has been removed several times. On July 27, 2022, the Spalding County Sheriff’s Office in Griffin arrested him on charges of simple assault – family violence and cruelty to child – third degree. Two days later, ERO Atlanta encountered Serrato Colorado at the Spalding County Jail and lodged an immigration detainer against him.

On Aug. 1, 2022, ERO Atlanta took custody of Serrato Colorado and transferred him to the Stewart Detention Center in Lumpkin. On the same date, ERO Atlanta issued a Notice of Intent/Decision to Reinstate Prior Order charging removability under the Immigration and Nationality Act because Serrato Colorado was a previously removed noncitizen. On Sept. 7, 2022, ERO Atlanta transferred him to the custody of the U.S. Marshals Service, Northern District of Georgia. On Nov. 29, 2022, the United States District Court for the Northern District of Georgia in Newnan convicted Serrato Colorado of felony unlawful reentry after removal in violation of 8 United States Code 1326 (a) and (b)(1) and sentenced him to time served.

ERO Atlanta took custody of Serrato Colorado on Dec.1, 2022, and transferred him to the Robert A. Deyton Detention Facility in Lovejoy.
